Terms & Conditions

1. DELIVERY, INSTALLATION & SPARES

 
1.1 Delivery timelines will be communicated upon order confirmation and are subject to logistical constraints.
1.2 The Company shall not be liable for delays caused by force majeure, transport strikes, or other uncontrollable events.
1.3 The Customer is responsible for installation unless installation assistance is specifically arranged with the Company.
1.4 The Company shall not be liable for any damage resulting from incorrect installation or mishandling by the Customer.
1.5 The Company does not provide on-site service. All services are conducted at the Company's service center.
*1.6 Transport charges shall be borne by the Customer. The Company shall not be responsible for any loss, damage, or misdelivery of material caused by the transport company.*
 
2. WARRANTY & LIABILITY
 
2.1 The Product comes with a limited warranty as communicated at the time of sale.
2.2 The warranty *does not cover*:
 
* Coin acceptor (under any condition)
* Water damage, burns, or intentional/accidental physical damage
* Misuse, unauthorized modifications, incorrect installation, or electrical surges
* Damage caused by the Customer or unauthorized third-party technicians
 
2.3 Warranty claims must be submitted via email with valid proof of purchase.
2.4 The Company is not liable for any indirect, consequential, or incidental damages.
2.5 Any hardware or software upgrades required during or after the warranty period will be chargeable, including transportation costs.
 
3. REFUNDS & CANCELLATIONS
 
3.1 No refunds will be issued once the Product has been dispatched, except in cases of verified manufacturing defects.
3.2 *Auto-Refund Policy*:
 
* The auto-refund feature applies *only* when water dispensing fails due to a machine-related error.
* It relies on third-party systems such as the WaterPay server, PhonePe, and SIM/network availability.
* The Company is *not responsible* for:
 
  * Refunds triggered despite successful dispensing
  * Issues due to failure in third-party systems
  * Financial loss arising from factors beyond the Company’s control
 
4. SERVICE & MAINTENANCE
 
4.1 The Company provides *remote support* for software issues via call or app.
4.2 For hardware issues, the Customer must send the faulty part to the Company’s service center. If out of warranty, repair/replacement costs will be borne by the Customer.
4.3 On-site service is not offered unless a formal, written maintenance contract is signed.
4.4 Routine cleaning and maintenance is the Customer’s responsibility.
4.5 *Support is available only* to trained dealers, distributors, or technicians registered with a valid *TM Code. Untrained individuals are **not eligible* for support.
 
 
5. OWNERSHIP & INTELLECTUAL PROPERTY
 
5.1 Ownership of the machine transfers to the Customer upon full payment.
5.2 All software and app-based features remain the *intellectual property* of the Company and are licensed, not sold.
5.3 Any attempt to *tamper with, reverse engineer, or modify* the software is strictly prohibited and may result in legal action.
 
6. LIMITATION OF LIABILITY
 
6.1 The Company’s maximum liability shall not exceed the purchase price of the Product.
6.2 The Company is not responsible for business losses, revenue loss, or damages due to misuse or malfunction.
 
7. DEFINITIONS
 
7.1 *Company: Refers to *Rowaale Water Technologies, the manufacturer and seller of the WaterPay Pro Model.
7.2 *Customer*: Refers to the individual, business, or entity purchasing the WaterPay Pro Model from the Company.
7.3 *Product: Refers to the *WaterPay Pro App-Based QR Water ATM Machine and its associated products and services.
7.4 *Agreement*: Refers to these Terms and Conditions governing the sale, installation, service, and maintenance of the Product.
7.5 *WaterPay*: A registered trademark and brand name of the vending machines manufactured by the Company.
 
 
8. NETWORK PROVIDER & UPI CHARGES
 
8.1 Any charges or policy changes introduced by UPI platforms (PhonePe, NPCI, etc.) or network providers will be applicable to the Customer.
8.2 Transaction, server, or API charges imposed by third-party platforms shall be borne by the Customer.
 
9. IoT SIM CARD USAGE POLICY
 
9.1 An IoT SIM card is provided for machine connectivity.
9.2 If the SIM is incompatible at the installation site, the Customer must purchase a compatible SIM (Airtel, Idea, BSNL – *Jio not supported*) at their own expense.
9.3 The IoT SIM remains the *property of the Company*, and activation or deactivation rights lie solely with the Company.
9.4 Misuse of the IoT SIM is a violation and may lead to legal action.
 
 
10. DISPUTE RESOLUTION & JURISDICTION
 
10.1 In the event of a dispute, both parties shall first attempt amicable resolution through mediation.
10.2 If unresolved, the matter shall fall under the exclusive jurisdiction of the *courts of Pune, Maharashtra*, India.
 
 
11. GENERAL CONDITIONS
 
11.1 The Company reserves the right to update these Terms & Conditions at any time without prior notice.
11.2 The Customer confirms they have read, understood, and agreed to these Terms before making a purchase.
11.3 Any additional terms proposed by the Customer must be agreed to in writing by the Company.
 
*Data Dashboard Terms:
 
• Includes 1-year free Premium Dashboard access from the activation date.
• After 1 year, subscription charges will apply (rates subject to change with prior notice).
• One-time 12-month trial only; paid access afterward.
• No refunds will be issued once payment is made.
• Access may be suspended after expiry or in case of misuse.
• Dashboard analytics are for internal business use only.
• WaterPay is not responsible for any business decisions made based on dashboard data.
• Terms may change at any time; continued use implies acceptance.
